Royal Decree-Law 9/2024, of 23 December, adopting urgent measures in economic, tax, transport, and Social Security matters, and extending certain measures to address situations of social vulnerability. Published in the Official State Gazette (BOE) on 24 December 2024.
This Royal Decree-Law extends into 2025 various economic, tax, and protective measures for vulnerable groups related to the real estate sector, including:
Support for vulnerable groups: The RDL extends until 31 December 2025 the suspension of eviction and repossession procedures initiated due to non-payment of rent, mortgage instalments, or expiration of contract terms. This applies whether a repossession date has been set or not. The measure also covers procedures initiated under Article 250.2, 4, and 7 of the Civil Procedure Act (LEC), including cases of illegal occupation or tenant occupation. Consequently, landlords are granted an additional year to apply for compensation for unpaid rents.
Promotion of public housing – SEPES: Specific provisions are introduced regarding the application of the legal framework to concession contracts aimed at construction or rehabilitation projects on publicly owned land or buildings intended for social housing or affordable prices. The terms governing the allocation of State-owned properties to SEPES for affordable housing policies are regulated through asset contributions outlined in Article 132.2 of Law 33/2003, of 3 November, on Public Administration Assets. However, the RDL exempts the requirement for prior valuation of contributed properties. SEPES will assume legal relationships concerning these assets.
Additionally, properties belonging to the Society for Penitentiary Infrastructure and Security Equipment (SIEPSE), as well as those integrated into MUFACE’s Special Fund and Royal Patrons managed by the National Heritage Administration Council, will also be allocated to SEPES. In these latter cases, ownership is retained while SEPES is delegated administration responsibilities to support the government’s affordable housing policy.
